利用規約（冷蔵庫の在庫管理とAIスキャン）

この利用規約（以下「本規約」といいます）は、Omochi Soft（開発者：Kotaro Omori。以下「当方」といいます）が提供する スマートフォンアプリ「冷蔵庫の在庫管理とAIスキャン」（以下「本アプリ」といいます）および本アプリを通じて提供される機能 （以下「本サービス」といいます）の利用条件を定めるものです。ユーザー（以下「ユーザー」といいます）は、本規約に同意のうえ本サービスを利用するものとします。

第1条（適用）

  1. 本規約は、本サービスの利用に関し、当方とユーザーとの間に適用されます。
  2. 当方が本サービス上または当方のウェブサイト等で別途定める各種ルール、ガイド、注意事項等は、本規約の一部を構成するものとします。

第2条（利用環境・アカウント）

  1. 本アプリは、ユーザー登録やアカウント作成を必要としない設計です。
  2. 本サービスの利用には、ユーザーの端末、OS、ネットワーク環境等が必要となり、これらはユーザーの責任と費用において用意するものとします。
  3. 当方は、特定の端末・OS・環境での完全な動作を保証しません。

第3条（データの取り扱い）

  1. 本サービスにおけるユーザーの入力データ（食材名、数量、価格、購入日、メモ、カテゴリ、レシート画像等を含みますが、これらに限りません。以下「ユーザーデータ」といいます）の取り扱いは、当方が別途定める「プライバシーポリシー」に従います。
  2. ユーザーデータは、原則としてユーザーの端末内に保存されます。
  3. ユーザーがiCloud保存（CloudKit）等の機能を有効にした場合、ユーザーデータはユーザー自身のiCloudアカウントに保存される場合があります。なお、当方はユーザーのCloudKit（プライベートデータベース）にアクセスしません。

第4条（禁止事項）

ユーザーは、本サービスの利用にあたり、以下の行為をしてはなりません。

第5条（本サービスの提供の停止・中断）

  1. 当方は、以下のいずれかに該当すると判断した場合、ユーザーへの事前通知なく、本サービスの全部または一部の提供を停止または中断できるものとします。
    • 本サービスにかかるシステムの保守・点検または更新を行う場合
    • 地震、落雷、火災、停電、天災等の不可抗力により提供が困難となった場合
    • App Store、iOS、CloudKit、AIプロバイダ（Google Gemini API等）、広告配信事業者等の仕様変更・障害等により提供が困難となった場合
    • その他、当方が提供困難と判断した場合
  2. 当方は、前項によりユーザーまたは第三者に生じた損害について、一切の責任を負いません。

第6条（有料機能・課金）

  1. 有料機能の概要
    本サービスでは、広告の非表示、カテゴリ編集、CSV出力、iCloud保存、レシートAI自動入力等の追加機能（以下「プレミアム機能」といいます）を、有料で提供します。
  2. 提供形態
    プレミアム機能は、以下の形態で提供されます。
    • 自動更新サブスクリプション：月額プラン、年額プラン等。
    • 買い切り型（非消耗型）：新規の販売は終了している場合があります。
  3. 既存の買い切りユーザーについて
    過去に買い切り型（Lifetime）を購入されたユーザーは、新規販売の終了にかかわらず、引き続きプレミアム機能をご利用いただけます。ただし、プラットフォームの仕様変更やサービス自体の終了等により利用できなくなる場合を除きます。
  4. サブスクリプションの自動更新
    • ユーザーが解約しない限り、購読は選択した期間（1ヶ月または1年）ごとに自動更新されます。
    • 更新課金のタイミング等は、App Storeの仕様に従います。
    • アプリを削除しても解約にはなりません。解約はApp Storeのサブスクリプション管理画面から行ってください。
  5. 購入手続・請求・返金
    購入、請求、解約、返金等は、すべてAppleのApp Store（StoreKit）により処理されます。返金の可否はAppleのポリシーに従います。

第7条（AI機能・レシート解析）

  1. 外部AIサービスの利用
    本サービスのレシート自動入力機能は、Google社が提供するGemini API等の外部AIサービスを利用して画像解析を行います。ユーザーは、本機能の利用にあたり、入力した画像データが解析のために外部AIプロバイダへ送信されることに同意するものとします。
  2. 精度の非保証
    AIによる解析結果は100%の正確性を保証するものではありません。誤認識や読み取り漏れが発生する可能性があります。ユーザーは、必ず解析結果をご自身で確認・修正した上で保存してください。
  3. データの非保持・学習利用
    当方のサーバーおよび外部AIプロバイダは、原則として送信されたレシート画像を永続的に保存せず、AIモデルの学習（トレーニング）にも使用しません（ただし、各プロバイダの規約変更や無料枠の仕様等により例外が生じる可能性については免責とします）。
  4. 免責
    AI解析の結果により生じた損害（家計簿の計算間違い、入力ミス等）について、当方は一切の責任を負いません。

第8条（広告）

  1. 無料版では、第三者の広告配信サービス（例：Google AdMob）により広告が表示される場合があります。
  2. プレミアム機能により広告が非表示となる場合がありますが、広告SDK自体はアプリに含まれる場合があります。

第9条（知的財産権）

本サービスに関する著作権、商標権、その他一切の知的財産権は、当方または正当な権利を有する第三者に帰属します。ユーザーは、当方の事前承諾なく、これらを複製、転載、改変、頒布、販売等してはなりません。

第10条（ユーザーデータの責任）

  1. ユーザーデータはユーザーの責任において入力・管理するものとします。
  2. 当方は、ユーザーデータの内容の正確性、完全性、適法性等を保証しません。
  3. 端末故障、OS更新、CloudKitの障害、ユーザー操作等により、ユーザーデータが消失・破損する可能性があります。当方はこれに関し一切の責任を負いません。重要なデータは、ユーザー自身で適切に管理（CSV出力等によるバックアップ）してください。

第11条（外部サービスとの連携）

本サービスは、iCloud（CloudKit）、App Store、Google Gemini API、広告配信等の外部サービスと連携する場合があります。外部サービスの障害、仕様変更、利用規約の変更等により本サービスに支障が生じた場合、当方は一切の責任を負いません。

第12条（免責事項）

  1. 当方は、本サービスに関して、ユーザーに生じた損害について、当方の故意または重過失による場合を除き責任を負いません。
  2. 本サービスの利用に関連して、ユーザーと第三者との間で生じた紛争等について、当方は一切責任を負いません。
  3. 本サービスは、家計管理・在庫管理等の補助を目的とするものであり、特定の成果（節約効果等）を保証するものではありません。

第13条（サービス内容の変更・終了）

当方は、ユーザーへの通知なく、本サービスの内容を変更し、または提供を中止・終了できるものとし、これによりユーザーに損害が生じた場合でも一切の責任を負いません。

第14条（規約の変更）

当方は、必要と判断した場合、ユーザーへの事前通知なく本規約を変更できるものとします。変更後の規約は、当方所定の方法で公表された時点から効力を生じます。

第15条（連絡）

本サービスに関する問い合わせは、当方が別途指定する連絡方法（サポートメール等）により行うものとします。

第16条（準拠法・管轄）

  1. 本規約の準拠法は日本法とします。
  2. 本サービスに関連して紛争が生じた場合、当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Use (Fridge Inventory & AI Scan)

These Terms of Use (“Terms”) set forth the conditions for using the mobile application “Fridge Inventory & AI Scan” (the “App”) and related features (the “Service”) provided by Omochi Soft (Developer: Kotaro Omori, “we”). By using the Service, you agree to these Terms.

1. Scope

  1. These Terms apply to all relationships between you and us regarding the Service.
  2. Any rules or notices we publish in the App or on our website form part of these Terms.

2. Environment / No Account

  1. The App is designed to work without user registration or account creation.
  2. You are responsible for preparing and maintaining your device, OS, and network environment.
  3. We do not guarantee perfect operation on all devices/OS versions.

3. Data Handling

  1. Handling of user-entered data (including Receipt Images) is governed by our Privacy Policy.
  2. By default, your data is stored locally on your device.
  3. If you enable iCloud saving (CloudKit), your data may be stored in your own iCloud account. We do not access your private CloudKit database.

We may suspend the Service without prior notice for maintenance, force majeure, or issues with App Store, iOS, CloudKit, or AI providers (e.g., Google Gemini API).

6. Paid Features / Subscriptions

  1. The Service offers premium features (e.g., AI Receipt Scanning, iCloud backup, CSV export) for a fee.
  2. Plans: Features are provided via auto-renewable subscriptions (Monthly/Yearly).
  3. Legacy Lifetime: One-time (Lifetime) purchase options may no longer be available for new users. However, existing Lifetime license holders retain access to premium features.
  4. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period via App Store settings.
  5. All billing, cancellations, and refunds are handled by Apple’s App Store.

7. AI Features (Receipt Scanning)

  1. Third-Party AI: The Receipt Scanning feature uses external AI services (e.g., Google Gemini API). By using this feature, you agree that your image data is sent to the AI provider for processing.
  2. Accuracy Not Guaranteed: AI analysis may contain errors. You must verify and correct the data yourself before saving. We do not guarantee 100% accuracy.
  3. Data Privacy: Uploaded images are processed for extraction purposes and are generally not stored permanently by us or the AI provider for training models (subject to provider terms).
  4. Limitation of Liability: We are not responsible for any errors in your inventory or financial records caused by AI analysis.

8. Ads

The free version may display ads via third-party services. Premium features may remove ads from the UI.

9. Intellectual Property

All IP rights belong to us or rightful third parties. You may not copy or distribute content without permission.

10. User Data Responsibility

You are responsible for your data. We are not liable for data loss due to device/OS issues. Please maintain backups (e.g., CSV export).

11. External Services

The Service relies on external services (iCloud, App Store, Gemini API). We are not liable for their failures.

12. Disclaimer

We are not liable for damages except in cases of willful misconduct or gross negligence. The App is a tool and does not guarantee specific savings results.

13. Changes / Termination

We may change or discontinue the Service without notice.

14. Amendments

We may update these Terms. Updates take effect when published.

16. Governing Law / Jurisdiction

Governed by Japanese law. Tokyo courts have exclusive jurisdiction.
